Privacy Policy

Data protection is very important for us. In this Privacy Policy we will explain which personal data we collect from you, when and why we do that, and how we process it. Of course, we comply with the legal provisions on data protection. Very important: We do not sell personal data to third parties. We have never done that and we will not do it in the future!

The person responsible within the meaning of the General Data Protection Regulation (GDPR) and other national data protection laws of the member states as well as other data protection regulations is:

In order to make the Privacy Policy more understandable, we will use terms such as "Rockinger", "we", "us" (and thus comparable) here. This always refers to the person responsible within the meaning of the GDPR. The GDPR also mentions "persons concerned". This refers to those whose personal data are processed. For this we will use terms like "users", "you" (and thus comparable).

What is Personal Data?

Personal data is information that can be used explicitly to find out your identity. This includes information such as your real name, address, telephone number.

Legal Basis for the processing of Personal Data

Before we describe all situations where we collect and process personal data, we would like to give you the necessary legal basis.

Art. 6 (1) b GDPR serves as the legal basis for the processing of personal data required for the performance of a contract (e.g. purchase contract). This also applies to processing operations that are necessary to carry out pre-contractual measures.

If the processing is necessary to protect a legitimate interest of our company or a third party, Art. 6 (1) f GDPR serves as the legal basis for the processing.

Insofar as we obtain your consent for the processing of personal data, Art. 6 (1) a GDPR serves as the legal basis.

Insofar as the processing of personal data is required to fulfil a legal obligation to which our company is subject, Art. 6 (1) c GDPR serves as the legal basis.

Personal Data of Minors

Persons under the age of 18 should not transmit any personal information to us without the consent of their parents or legal guardians. We do not request or knowingly collect personal data from children and young people. If we become aware that a user under the age of 18 has either registered with us or otherwise interacted with us without the consent of a parent or guardian, we will immediately delete all of that user's personal data.

When do we collect Personal Data?

Contact and Support

If you contact us e.g. by contact form, e-mail, telephone or via social media, your details for processing the inquiry and its handling will be recorded (if necessary name, address, telephone number, e-mail address, social media data, message text). We use this information to inform you about our company and our products and to answer your technical or other questions - even after purchasing our products. It is in our legitimate interest to use your personal data for this purpose and it may be necessary to fulfil a contract entered into with you or to carry out a pre-contractual measure. If the legal basis is unclear, we will ask for your consent. Your data will be deleted (subject to legal retention periods) as soon as they are no longer required by us. We review the necessity once a year.

Online Customer Account

On our website you can place an order as a guest or you can register voluntarily with an online customer account. In the course of this registration we collect personal data (name, address, e-mail address and, if applicable, delivery address and telephone number). Setting up an online customer account is done with your consent and serves to speed up the ordering process. Your e-mail address and a password of your choice are required for the login process. In order to protect your account from unauthorized access, you must keep your password secret and may not pass it on to third parties. Of course we will never ask you for your password. You can revoke your consent to the data processing for the online customer account at any time by notifying us. In this case we will delete your online customer account. Please write the revocation by e-mail to info@rockinger.com. We will respond to all inquiries in this direction as soon as possible, but at the latest within 30 days.

Orders

If you order something from us, you can do it either by telephone, fax or via our website. In order to complete your purchase, we require personal data. We save your name, address, e-mail address, delivery address, telephone number and payment information. We use this data to process your purchase, to inform you about the delivery status and to process any returns. The processing of your personal data is necessary for the fulfilment of the contract entered into with you.

If you do not provide us with your personal data, the contract cannot be concluded.

Catalogue Request

You can request our free catalogue via a form on our website. In order to send you the catalogue, we collect personal data (name, address). By sending the catalogue request, you agree to the processing of this data. Of course you have the right to revoke this consent at any time with effect for the future. E-mail Newsletter

We regularly send out newsletters to inform you about new products, special offers or other news about our company. If you are interested, you can sign up for this newsletter. All we need is your valid e-mail address. If you register to receive the newsletter with your e-mail address, a double opt-in confirmation e-mail will be sent for legal reasons. This confirmation e-mail serves to check whether you really are the owner of the e-mail address you provided and have authorized the receipt of the newsletter.

The personal data collected in the context of your registration for the newsletter will be used exclusively for sending our newsletter. Of course, your e-mail address will not be passed on to third parties. Consent to receive our newsletter can be revoked at any time with effect for the future. Instructions can be found in every e-mail newsletter.

Social Media

We operate a Facebook and a Instagram page to interact with our customers and prospects active there and to inform them about our company and our products. When you access our Facebook or Instagram page, the terms and conditions and data processing policies of Facebook and Instagram, respectively, apply.
If you contact us via Facebook or Instagram or post there, we will only process your data within the scope of this privacy policy.
In addition, your personal data will be collected, used and stored not only by us, but also by the operators of the respective social network. This also happens if you do not have a profile in the respective social network. The individual data processing operations and their scope differ depending on the operator of the respective social network and are not traceable for us.

Third-Party Vendor

We engage third parties to provide services on our behalf. These include website hosting, credit card and payment processing, parcel services and lettershops. In the event that you have requested services from us, we will pass on your personal data to the responsible third party providers. However, only so that they may provide the services described herein on our behalf and in accordance with this Privacy Policy. It is in our legitimate interest to use your personal data for this purpose and it may be necessary to fulfil a contract entered into with you if necessary. PayPal

Among other payment options you can also pay via PayPal. All PayPal transactions are subject to PayPal's Terms and Conditions and Privacy Policy.

Forced Disclosure

We disclose your personal data when required to do so by law (e.g. to legal authorities) or when it is absolutely necessary to protect our rights or users.

Cookies

Like almost all companies, we also use cookies on our website. Cookies are text files that are saved in the Internet browser or by the Internet browser on the user's computer system. If a user visits a website, a cookie may be stored on the user's operating system. This cookie contains a characteristic character string that enables a unique identification of the browser when the website is called up again. 

We use cookies to make our website more user-friendly. Some elements of our website require that the calling browser can be identified even after a page change. Log Files

You can visit our website without providing any personal information. However, each time our website is accessed, our system automatically collects data and information from the computer system of the calling computer and saves it in log files. These include:

The IP address of the user
Date and time of access
Websites from which the user's system reaches our website
Websites accessed by the user's system through our website

The data is saved in log files to ensure the functionality of the website. In addition, the data serves us to optimize the website and to ensure the security of our information technology systems. It is in our legitimate interest to store access data for these purposes. It is not possible to identify a person using this information. IP addresses are deleted daily.

Links to Websites of other Companies

Our website contains links to websites of other companies. We have no influence on whether these companies comply with data protection regulations.

Security and Storage

The protection of your personal data is of the highest priority to us, which is why we take appropriate protective measures. However, we would like to point out that every security system can have gaps. 

To protect your personal data from loss, theft, misuse, unauthorized access and unauthorized disclosure, alteration and destruction, we save them on specially protected computer systems in Germany. In addition, your data is protected during transmission over the Internet by encryption technologies such as TLS and SSL. Of course, you are free to transmit all personal data to us by telephone.

Your Rights

If the legal requirements are met, you have various rights with regard to your personal data collected by us. These include: Right to information, correction, deletion, restriction of processing and data transmission. Details can be found in Articles 15 to 20 GDPR. At this point we would like to point out once again that we must comply with legal retention periods.

Furthermore, according to Art. 21 (1) GDPR, you have the right to object to data processing based on Art. 6 (1) f GDPR and to processing for direct promotion. This means that anyone who has registered with us for the e-mail newsletter can unsubscribe at any time. Instructions can be found in every e-mail newsletter. If you have requested our catalogue but no longer wish to receive it, you can unsubscribe at any time. Please send an e-mail to info@rockinger.com for this purpose. 

The revocation will immediately be noted in our database and from this point on no more catalogues will be sent to you.

Right of appeal to the Supervisory Authority

If you believe that we have not processed your personal data lawfully, you have the right to complain to the competent supervisory authority in accordance with Art. 77 GDPR.

Changes to our Privacy Policy

We may change or update this Privacy Policy as necessary. We therefore recommend that you check it regularly. If we update it, we will update the 'Last Update' date accordingly.
